WELLINGTON, November 16. Seven counsel were present in the Supreme Court at the hearing of an application by Lady Hunter for a variation of the order in June, by making further and better provision for her out of the estate of her late husband, on the ground that her financial circumstances had become further embarrassed.

Justice Blair held that he could not entertain the application and dismissed it, allowing costs out of the estate of all parties other than the applicant. Counsel, Mr Perry, suggested that if fresh proceedings were taken on behalf of the child Betty, it might be possible for Lady Hunter to invoke subsection 7, section 33, of the Family Protection Act, and that might be a solution of the present difficulty.
