Twiuer was, heard before Mr. Justice Reed, who decided that the n,on-disclosure by defendants of a railway department proclamation, affecting the property .sold, constituted a, vital defect of title, .and entitled Stuart to. ' rescind the contract. . .« , Judgment was given in favour of Stuart for the. return.,,of, deposits paid, and costs. Counsel appearing were from 'Hokitika and Wellington,, a« the decision affects a number of similar contracts.
