\ “EXTRAORDINARY TRAFFIC.”

WELLINGTON, August 11

.The practice of driving cows regularly along the. road may be classed as “extraordinary traffic,?’ and the owner nitty be liable for dpmttge to road,’ according to legal opinion' taken by the Frttnklin county clerk (Air A. P. Day). Complaints had been received by the council from two ratepayers in different parts of the county that cows being driven along)' their aceeee road twice daily w%re causing considerable damage ■ to such roads. They asked that somei action be taken to abate the nuisance. The county clerk took legal opinion, which; stated that the driving of cows twice daily along a road could be held to be “extraorddinary traffic” and the cost of any damage on roads caused thereby could be recovered- under the Public Works Act. Ah last meeting of the county council the clerk reported he had asked the settler concerned to cease driving cows along the road in question during wet weather, or at any time when damage Was likely to be caused to the road.
