The action was brought by Sir Kenneth as the result of severe injuries when ho was knocked down by a Victora Laundry van driven by William Albert "Weldon at the junction of Constable and Riddiford Streets in 1930. On the jury’s answers to the issues, his Honor entered judgment for plaintiff if or £347 special and £BSO general damages, with costs according to sc°le witnesses’ expenses and disbursements Mr Leiceter raised the question o c whether the jury’s answers did not amount to a verdict in favour of defendant, and His Honor reserved leave to the defendant company to move for a nonsuit of judgment. All questions relating to the costs of the first trial were reserved in the meantime. His Honor said he would! take an early opportunity of consulting with Mr Justice Blair, who presided at the first trial, as to his views on the subject.
