AN ACTRESS’ WILL
A COURT DECISION

Emelie Polihi, a well-known actress, whose.death occurred in. America some time ago, left a will which came before •the New South Wales Courts for interpretation. Testatrix excluded a widower, who is an Australian, from the will and left all her money to a four-year-old daughter, Patricia, on condition that she was taken from the father, and reared by an uncle and aunt in England,' but should the father decline to agree to this arrangement, then the child’s 'inheritance should he substantially ' reduced. The Court held that the testatrix’s condition was opposed to public policy, and was likely to deter a father from performing his parental duty, which was sacred, just as were his rights. Therefore the gifts to Patricia were absolute. Under this condition, the child will inherit the whole estate' when 24 years old, totalling about £20,000.
