Stuart and Chapman Ltd. (Air Murdoch) v. Wm. de Bakker and I liomas Croft (Air Elcock). Adjourned from Ross Court for argument. Alter bearing counsel the Warden stated he had no difficulty in coming to a decision. The plaintiffs had a water right that they were using for the supply of pure water for their mill. They found sludge coming in the water and louud the cause was the result ol workings by the defendants. It was admitted that defendants had no license lor a claim and no water race, having no In wild right beyond a miner’s right. He found that be was acting without legal authority. lie found for plaintiffs. Judgment would be given for damages claimed 933 10s and costs .97 18s, and an injunction would be given against defendants interfering with the water.
