AN IMPORTANT DECISION. AUCKLAND, Sept. 7.

An important law point affecting insurance policies was laid down by Justice Stringer to-day, when he gave judgment for £IOOO in favour of Roy Ernest Eastman, a building and drainage contractor against the Eagle Star and Dominion’s Insurance Coy, Ltd., aiul New Zealand. Insurance Coy., Ltd Workmen were seriously injured by the collapse of a drain at Claudelands, Hamilton, and obtained £1267 damages and costs From the employer Eastman, who he hi a policy for £IOOO covering accidents to his workmen, but tho defendant companies refused to pay on the grounds that according to the terms of the policy, only operations in Auckland city and suburbs were covered. Justice Stringer said where a proposed insurance was in connection with factories or shops the question as to situation of the premises was quite appropriate and might be important in. determining the nature of the risk but the question appeared to ho quite inappropriate where a proposal concerned a building and sewerage contractor, the business of which as the parties must have known, has no local habitation and from its very nature, was always changing its scene of operations.

COLLISION ENDS FATALLY. AUCKLAND, Sept. 6. Lawrence Charles Seaton, aged twenty-four, who was injured on May 8, through a motor cycle lie was riding colliding with a motor-car, between Papateoteo and Otaliuliu, died in Auckland Hospital to-day. Seaton sustained a fracture of the leg and serious injuries to the bead. For some time be appeared to be recovering but suffered a relapse.
