PROVINCIAL COUNCIL.

FRIDAY, January 22nd, 1864. The Council met at 3 p.ra. Present All the members, excepting Messrs. Bousfield, Colenso, Dolbel, and Edwards. Validity of Mr. M’Lean's Seat. Mr. Tiffen, having obtained suspension of Standing Rule 116, moved—- “ That doubts arisen as to the right of Donald M’Lenu Esq. to sit in this Council as member for the Napier Country district, his honor the Superintendent shall, without delay, obtain the opinion of the Attorney-General as to the validity of the said member’s seat.” The motion was seconded by Mr. Tuke. After some explanation, however, by His Honor on the subject, Mr. Tiffen withdrew the motion. Loan Amendment Act. This Act was read a third time and passed on the motion of Mr. McLean, seconded by Mr. Curling. Validity of Mr. Colensd’s Seat. The following motion made by Mr. Rhodes was then put and agreed to : ■ “ That doubts having arisen as to the right of t Mr. Colenso to sit in this Council, it is the opinion of this Council that his honor the Superintendent shall without delay obtain all the evidence that can bo procured as to- the disqualification of the

said member. Should this evidence be conclusive, it is the opinion of this Council that a new writ should be issued in accordance with clause 12 of the Constitution Act and provisions of the Disqualification Act of the General Assembly of New Zealand.”

£looofor Repairing Dredge . Standing Rule 27 having been suspended, Mr. Ormond moved—

“That this Council undertakes to idemnify the Superintendent in respect of an expenditure not to exceed one thousand pounds for placing the steam dredge in an efficient state of repair, with the view to her being used for loading and discharging vessels in the Ahuriri roadstead, or as a steam tug, if required. Mr. Tiffen seconded the motion, which was put and agreed to.

His Honor then thanked the members for their attendance, and declared the Council to be prorogued.
