3 Civil Case Results In Siipreme Court

Three actions for. damages are being heard simultaneously before Mr Justice Ostler and a jury of four in the Supreme Court at Napier to-day, all arising out of the same motor accident. Two claims are made against James Coleman by Eichard Joseph Burke, driver of the other car, and Peter John O'Eegan, his passenger, r/hile Coleman has counter-claimed against Burke. Butke claims £139 11/6 special and £200 general damages, and O'Eegan £36 13/- special and £100 general damages. The counter-claim is for £159 12/4, special and £25 general damages. Mr A. M. Ongley appeared on behalf of each of the two ' def endants, Burke and O'Eegan, while Mr C. G. E. Harker appeared in defence. The jury of four engaged in hearing the case is: Messrs J. S. Tonkin (foreman), C. J. Brown, W. Mongari, and L. M. Theakstone. The acoident occurred in a cutting north of Norsewood, said Mr Ongley. A minor slip had fallen upon the edge of the bitumen Toad and it was alleged that Burke had been travelling south qt a moderate pace when Coleman 's car came down the hill fast, and slid sideways on the wet road, Coleman apparently applying his brakes at sight of the slip, his excessive speed causing the skid, and the crash into defetxdant's c£ir. .
