WELLINGTON, This Day. Tho CoUrt of Appeal was engaged today in tho lioariug of a case inyolving a claini to an ostaLo consisting oi" uutive land, valucd at appruxiuiateJy £10,000. Procoodings wero taken iu tho Suprcnio Court lust year on bokalf of the next-of-kiu (nephows and nieces) of Teo Tipene, deceased, for a declaratory judgment as to tho status of an appellant, Robert Victor Tipene (othorwise known as Le Sucur), of Wellington, a lubourer, who claiins to bo the adopted son of deceased. When Teo Tipono died ko lei't no natural children surviviug and if tho appoliant is iu law his adopted son, thon he would bo ontilled to sueceed lo the whole of the deceased'a estatc. Mr Justico lleed, before wlioni the case was heard, made declarations: That an order of adoption of tho appellant by Teo Tipene and Meri Tipene, purporting to have been made orally by a magistrate at Wellington in 1900 was invalid as an adoption order under the Adoption of Children 's Act, 1895. That in law, Teo Tipene and Meri Tipene were not on any relevant date husband aud wife within the meaning of that Act. Appellant is appealing against tliese declarations on the ground that they are orroncous in law and fact. Respondent in Ihe case is Tutua Teonc, of Wai, whetu, y boriginal irativc. ^Procecding,')
