Judge Holds Fraud is Established

CHRISTCHURCH, Last Night. Holding tliat the contract was procured by fraud, Mr Justiee Kennedy, in a reserved judgment issued to-day, ordcred tlie Australian Investment Corporation Ltd. to re-transfer to George Herbert Elliott £540 worth of debentures in the Investment Executive Trust of New Zealand Ltd and pay him £180 for dividends received from the PubJic Trustee in respect of the debentures and £60 paid by Elliott. The judgment provided that Elliott should return to tlie company itg shares allotted to him. Costs were also granted to Elliott, who is a retired art master of Palmerston North.
