UNUSUAL PROSECUTION
Man Charged With Trespasi 0n Raiecioiirse * ^ . . prohibited by conviction An unusual prosecution — that of trespass on a racecourse when absolutely excluded hy virtue qf a convietion under the Gaming Act— was hearj by' Mr J.. Miller, S.M., in the Napier Magistrate' s Court this morning. Lyall Mount Newman, of Napier, meehanic, was fined £2 with 10/- costs for the otfence. Detective K. W. Mills explained that in company with the racecourse inspeotor, he had found Newman at the course on June 9. Defendant had been convicted in 1933 of keeping a common gaming Kouse. For the defendant, Mr Nash explained that he had given up bookmaking and was now employed as a meehanic. Recently he had explained this to the racing autborities, and had aP* plied for permisBion to attend ! the course once more. He had been asked for further particulars, and was puzzled at not receiving a further reply. After he had been found on the course he found that he had failed to post the letter.
