Man Sues Ex-Fiancee For £10 NON-SUIT ENTERED

CHRISTCHURCH, This Day. A sequel to & broken engagement was heard in the Magistrate's Court this morning when the man concerned, D. M. Carey, a paper-runner, of Christ- | church, sued Helep. Christie, also of Christchurch, claiming £10 allegedly lent to her in settlement of an ac-. count. In his statement the plaintiff set out that he claimed from the defendant £10 lent and advaneed to her and by her direetfon and paid by him to Messrs Irwin and Irwin, of Dunedin, solicitors, in settlement of an account owing by the defendant. Alternatively, the plaintiff claimed to recover from defendant £10 paid on her account in consideration of an engagemeint to marry which had been entered into between the plaintiff and the defendant, which engagement .was later broken cff by the deiendant. Mr Reid heard the case and counsel wete Mr K. G. Archer, for the plaintiff, and Mr R. A, Young, for the defendant. Carey, in evidence, said that Miss Christie had promised to marry him. She told him at the time she was divorced but did not have the decree absolute, but added that if he produced -the money tcv gei the decree absolute sh© would marry him. Accordingly, he paid the £10 necessary in April of last year. He kept company with her until last show day. "Three times preparations were made for a marriage," witness added. "My people were all ready5 but she turned us down flat. We had even gone as far as going to thet>registrar and had flxed the date and signed papers. "Miss Christie would not go on with it, however. Each time the date was fixed she was responsible for the marriage not going on." Witness continued that Miss Christie was friendly with another man and it was deeided to write to him. Part of the letter produced was in Miss Christie' s writing and read: "I think it is time we had aa immediate understanding." The engagement was immediately broke off when they liad a disagreement on show day. As far as thp marriage was concerned. he would have gone through with it on each of the three occasions. "When Miss Christie would not marry me I asked for my money back," Carey' s evidence concluded- "However, she said it was only a 'fleabite' and refused to giv© the amount back." After hearing evidence the Magjstrate non-suited Carey. "Perhaps he is unfortunate," he said; "but, on the other hand, he may not be. The experience may be cheap at £10."
