WARDEN'S COURT, RUTHERGLEN.
Monday, August 3. (Before M. Keogh, Esq., R.M.) Keating -to. Moynihan and Co. — An adjourned case, to receive the report .of assessors from the Eight-mile Terrace. A report was handed in, but as neither of the assessors were present, and as Keating raised objections, the Warden decided on appointing fresh ones, and adjourned the case for another week. Moynihan and Cr. v. Smith and Gafney. — Another adjourned case respecting a tunnel which Moynihan wished to take in through defendant's ground. It was agreed that Moynihan should pay ,£lO to Smith for four feet of ground, but that Gafney and Wraith should have the right to take out the ground abutting on the tunnels, ' and that the responsibility of securing the same should rest with Moynihan and Co. Couch and Co. v. Cavanagh. and Co. — It will be recollected that these parties had an appeal case tried lately before Judge Clarke, who decided in favor of Cavanagh and Co., but left the matter of compensation tq be decided by the Warden. Couch and Co. therefore summoned Cavanagh and Co. for £647 as compensation for the loss of their tunnels &c. The Warden decided on appointing assessors, and adjourned the case for a week.
