MAGISTERIAL.
CHRISTCHURCH. Friday, September 23. [Before O. Whitofoord, Esq., R.M.] Drunkenness —For a first offence two men wore fined 5s each, or twenty-four hours’ imprisonment. Joanna Gallagher, who hss been convicted about forty times, was fined 2Ds, or ninety-six hours’ imprisonment, for using obscene language in a public thoroughfare.
Embezzlement.—Patrick James Kennedy was brought up on a warrant issued at Melbourne charged with having converted to his own use two sums of money, £l4 6s and £7 3s, tho property of Robert Harper and Co., of Melbourne. Win. Nixon Bell, constable of police, Victoria, deposed that he knew prisoner, for whom ho produced a warrant of arrest issued by Mr MoColl, a police magistrate at Melbourne, on the charges above-named. He also produced certified copies of depositions taken before tho magistrate at a hearing when witness was present. Detective Noil stated that on his arresting prisoner ho said he was the man named in the warrant. Prisoner made no statement. He was remanded to Lyttelton gaol until a warrant should issue from under the hand of his Excellency the Governor for his further remand to the colony of Victoria.
Larceny.—James Finn pleaded guilty to stealing, on September 22nd, a pair of boots valued at 17s 6d, from the shop of B. J. Hale, bootmaker, Cashel street. Ho said he was drunk at the time ho committed the offence. There were six previous convictions for larceny against tho prisoner. He was sentenced to three months’ imprisonment, with hard labor. Stealing from the Person. —Edward Brick was charged with robbing Thomns Brogdon of £2 3s 6d. According to the evidence, prosecutor and prisoner went in a cab to Sumner on September 21st and, on the way, the cabman, through the trap in tho cab, saw prisoner take from tho prosecutor's trousers’ pocket two £1 notes, a halforown, and sixpence. The cabman afterwards taxed prisoner with tho theft, which was denied. The above facts were proved by tho evidence of Good the cabman, and Lizzie Gilligan, who was overcome by emotion in tho box, barmaid at the Victoria Hotel. Prosecutor said ho did not believe that prisoner intended to keep the money. Prisoner, while he admitted having taken the money, said he simply took it to take care of it. The Magiitraco said he had no doubt tho affair was a robbery. Ho complimented tho cabman on the way ho had behaved, and ordered that of tho money recovered he should receive 7a for his expenses. The prisoner was then sentenced to throe months’ imprisonment with hard labor.
