(Pitr Press Association.) Wellington, last night. The Appeal Court was to-day engaged hearing the case of the Westport Coal Company versus Champion. In this oase Isaao Champion, father of John Champiort, had recovered £3OO in the Dietriot Court for loss of his son, killed in an accident on the company’s line. The company held that the acoident was due to deoeased’s own negligence. The Chief Justioe to day gave an important deoieion in the case of Reese v. A. Bailie. The oase wbs an appeal from the decision of the Magistrate at Pahiatua lin 1902, ipsfendanls, a firm of printers, were made parties to an Arbitration Cpurt award, and plaintiff continued tp reoeive Isss wages than those fixed by the award. In August, 1904, he oommenced an aolipn jo reooyor £QI 16s, tho difference between the wagps received and tho minimum rates spee fied in the award. The Magistrate gave judgment for defendant, and plaintiff thereupon appealed. It was contended that as appelant had received his wages without question, be oould not now oomplain he had not received the full wages. The Chiet Justice was of opinion the parties oould not contraot for servioee at a lower wage than tho award without permission of the Count. The appeal was allowed, and judgment given for the amount claimed, with cools. i
