Cooksley and SDother purchased the rights to tho official card from the Wellington Raoing Club, and Johnson and Sons printsd another for , one Donovan, by whom it was published and sold, Cooksley sued and obtained damages for £76 in the S.M. Court, but the Chief Justioe and Judge Cooper upset j the decision, on, amongst other grounds, that appellants had no oopyright in the offioial card till its actual publication, and there was not sufficient evidence that defendants had printed and delivered to Donovan after publication of tbe official oards. From this decision appellants now appeal. , .• •
