DEFAULTING WITNESS
FINED j£2o OR 14 DAYS’ IMPRISONMENT.
;(Per Presa Association;.) Auckland, last night. In the Magistrate’s Court this morning, Mr C. C. Kettle, S.M., inflicted a fine of £2O upon a witness named’ James MoQuoid, who had failed to attend the Court after being subpmnaed twice. No expenses having been tendered in the case of the first subpoena, a . second .was issued and served along with the customary tender for expenses. Yesterday the tfaso again came before the Magistrate, and McQuoid did not appear. After some discussion, the case was again adjourned until this morning to enable defendant to take proceedings against McQuoid for disobeying the order of the Court, The case came on again this morning, and still there was no appearance of McQucia. The Magistrate said that it seemed to be a case of deliberate defiance of the process of the Court, and of gross contempt. He considered it his duty to inflict a fine, considerable inconvenience having resulted from Quoid’s recalcitrance, and he therefore l fined him the maximum sum of £2O, with the alternative of 14 days’ imprisonment. It would be open to McQuoid to apply to have the fine reduced if he could show reason for it.
