THE SMITH CASE.
THE DECISION QUASHED.
(Per Press Association.) Auckland, last night. Judge Edwards gave judgment in the caso of Abbotsford Smith v. Mary E. $ Smith, an appeal from a Gisborne decisionthat tbe appellant intended to desert his wife and three children, and a maintenance order with a surety of £IOOO. The Judge said that a conviction for more than one offence was void, and the same applied to T 1 an order in respect to more than one J matter of complaint. He regretted ho was forced to the conclusion that the order did not cover more than one matter of complaint. Separate complaints and separate orders coaid have been made in respect to tho intended desertion of tho wife and each of the children. He was relnctantly compelled to allow the appeal and qnash the order. This would not bar further pro- ft ceedings. He did not allow costs.
