Wellington, last night. 3 Dr McArthur, S.M., this morning decided e point raised by counsel for Henry Peacock, who was charged last week with being the occupier of a billiard saloon frequented by reputed thieves. Counsel had contended that it was necessary to prove knowledge on the port of defendant of tho k. Character of the peoplo in his place, and /- thut tho police had failed to provo such knowledge,. His Worship decided against this plea. Ho said he thought want of knowledge on tho part of defendant of tho Zcharactcr of those who frequented his houso was no answer to the charge, but might be a matter fur tho mitigation of tho penalty. The occupier of a houso must satisfy himself as to the character of those who frequented it.
