The Appeal Courtis engaged in hearing a point raised in the Mabin case whother tho Criminal Code Act has abolished criminal libel. Mr Bell argued for the Crown that an indictment could be maintained under the English statute known as Lord Campbell's Act. Mr Ilindmarsh, for defendant, contended that this Act merely provided different punishment, and did not create a fresh statutory offence. Judgment was reserved. In King v. Bannatync and Co., preliminary objection was taken that tho Crown had not given security, but tho Court was unanimous that this was not necessary.
