A feeling, backed to some extent by legal opinion, is prevalent that, however, legal the Federal Government’s position may be in regard to tin breaking of the ships seals, as far as British ships are concerned, a new factor comes into the problem when a foreign vessel comes in question ; while that refusal to allow the discharge of cargo raises an oven more debatable point. In reply to a strong protest Mr Kingston has now informed the German Consul General, that he gave no orders to stop the discharge of the “Luitpold’s ” cargo.

Mr Barton bolds that there is no international question involved. The law app’y’s to all vessels, and foreign ships arc entitled to no more consideration than the British.

The “ Neckar's ” captain has given notice to appeal against the conviction, and has deposited £SO as security of the appeal. He was thereupon liberated and triumphantly escorted to the steamer, where the passengers presented him with a gold locket. Melbourne, Dec 21.

Leave was given to appeal to the Privy Council against the conviction of the Captain of the Oceana for breaking the Custom’s stores.
