In the Otago Harbour v Lysight caso the Chief Justice was of the opinion that the Harbour Board had no power under law to undertake the duty of receiving and delivering of cargo, but if it had then it would be liable for negligence. Judges Donniston, Connolly, and Edwards, held tho Board could undertake stevedoring and wharfingers work and the appeal wa?, therefore, dismissed with costs on a middle scale.
Tno Appeal Court adjourned until November 27. Motions for leave to appeal to the Piivy Council will be taken then.
