BREACH OF THE LICENSING ACT.

Wanganui, Oct 10.
At the Magistrate’s Court to-day before C. C. Kettle S.M., Joseph "William Hands licensee of the Wangaehu Hotel, was charged on four counts”with selling liquor on the 12th and 13th September to George Henry White, already in a state of intoxication, and with permittirg drunk mness op the swo dfltes,
Mr Cohen (Marton), appeared for defendant who pleaded not guilty.
The evidence disclosed the fact that the man alleged t 6 have been served went to Wfcn'gaehd Rfte'r a drinking about in town ’and was permitted to stay there while suffering a recovery. Several witnesses swore to seeing the man at different times during his stay at Wangaehu and at no time the worse for liquor.
The man was subsequently brought into town and a day or two after was taken to the hospital, suffering from the effect of alcoholism and drink.
Counsel contended that the probability was that the man started drinking again in town and that there was no confirmative evidence in support of the charges against his client. The Magistrate said the evidence did not satisfy him and the information ivas dismissed.
