The parties who were neighbours, have been at variance for many years, and have been engaged in litigation in various ways on several occasions. On the present one the immediate cause of the trouble was the leaving open of certain gat 48 in the Hurunui rabbit fence, which defendant considered had been left open by plaintiff in order to annoy him. The jury returned a verdict for defendant.
