(Per Press Association. 1 ) Napier, October 1. Afc the Magistrate's Court to-day, H. Peters sued the Hawko's Bay Jockey Club for £10, the Maiden Steeplechase stake won by the plaintiff's horse Austral at the winter meeting of 1894. The stake was withheld on a protest that Peters and his horse were on the unpaid forfeit list, being indebted to the Reef ton Jockey Club to the extent of £2 15s. It was contended for the plaintiff that the Reef ton Jockey Club was uofc a metropolitan club within the meaning of the Gaming Act, and that the publication of the unpaid forfeit list appeared after the race had been decided, The defence was that the decision of the Jockey Club must be final and binding, which contention was upheld by the Magistrate, who non-suited the plaintiff, with costs. Sullamore and Saracen for the Caulfield Cup.
