Infringement of a Trade Mark.

(Per Press Association.) Wellington, Sept. 28. Tbe civil litigation pending between Joseph Wertheim, sewing machine manufacturer, against B. F. Davy in respect to alleged infringement pf plaintiff's trade mark by defendant has been settled. Defendant consents to judgment being entered against him . with an injunction restraining the unauthorised use of plaintiff's trade mark. The criminal proceedings have yet to be dealt with by the Supreme Court, but it is understood that the prosecutor having obtained au injunction, will ask leave to withdraw from the prosecution.
