Alleged Overflow from Kiwitea Stream.

At the meeting of the Borough Council lust night, the report of ths Committee appointed to inspect the locality where it was alleged the Kiwitea stream overflowed its banks and flowed into the Makino was read as follows: — "We, two of the members of the committee appointed by the Council to inspect the alleged overflow from the Kiwitea into the Makino, beg to report that on July 17 last, in company with Cr. Allan, Messrs Booth and Wheeler, wardens of tho Manchester Road Boiud, Mr Fry and Mr Little, made an inspection of the Kiwitea stream where it runs through Mr Fry's property ; we also followed the course of the stream to the Cheltenham Cross road. We could sec nothing to warrant us in supposing that the water from the Kiwitea stream where it traverses Mr Fry's land, overflows andjfinds its way into the Makino. There was not, sufficient time to enable ns to follow the course of the Kiwitea back again and into Mr Bell's property, but from the nature of the high ground on the western bank of the stream we are disposed to think that the water from that stream when in flood does not flow into the Makino, although in our opinion it would be impossible to give a definite opinion unless the levels of the adjoining land were taken, or the Kiwitoa j stream were inspected during the course of a flood. We desire to express our thanks to Mr Fry, who very kindly conducted us over his property ; and in conclusion beg to report that we have no ' recommendation to make, — (Signed) W. A. Allan, one of the committee appointed refused to sign this report be cause he was still of the opinion that there wos an overflow from the Kiwitea in Mr Elkington's property, eventually coming through the town. There were strong indications that the flood went into a swamp which led into Mr Fry's. The inspection made by the committee was very indifferent. Since then he, with Cr. Saywell, had inspected the locality again, and he was still of the same opinion. There was no proof to show why that overflow through the swamp did not go into the Makino. He did not see what the Council could do in the matter, but thought property owners should do something towards keeping the course free from rubbish. Cr Goodbehere did not say there was no overflow, but in his opinion there was some. As far as they inspected there was no overflow, bat he could not say what it might bo lower down below Mr Fry's. It had been stated the Makino was higher on Furlong's road than the Kiwitoa, and others held it was the reverse. No person could go and tell with absolute certainty whether there was an overflow without levels being taken. He would suggest that levels be taken if the Council were not yet satisfied. Cr Saywell said lie went up with Cr Allan, and there were strong indications of the Kiwitea overflowing from MiFry's into Mr Elkington's, but he agreed with Cr Goodbehere that they could not tell with certainty unless levels were taken. The Mayor did not think there was an overflow in Mr Fry's into tha Makino, although there fwere undulations where the Kiwitea overflowed, but went back again. He did not see what they could do without taking levels. Cr Gould was informed by a person who was in the locality at the time of the flood that there was not any overflow. Cr Allan said the overflow was not in Mr Fry's but in Mr Elkington's, and that the bank referred to terminated at Mr Fry"s fence, and this was where the flood-water found its way over a flat and into the Makino. The discussion then dropped, it being resolved, That the report of the Committee re overflow into the Makino be received.
