Thursday, 7th February. (Before District Judge Martin). IN BANKRUPTCY. "Re Emma Finnis, application for dis charge. — The D.O.A. having submitted a favourable report, the application was granted. —Mr Hurley appeared foi debtor. Re Henry David Hopkins, application for discharge. Mr Hurley, who appeared for debtor, said the matter had been before Judge Kettle on a previous occasion, who had expressed his sympathy with the bankrupt, but adjourned the application for six months to enable debtor to try and make an offer to his creditors. Since then debtor had met with an accident, which prevented, him from making an offer. — The order oi dischar ge was granted. Re Charles A. Kendrick, public examination. — Mr Reade appeared for debtor, and Mr Hankins for the D.O.A. — Debtor, in answer to questions, said : In April last he leased a farm of 105 acres from E. Porter at a rental of £'44 per annum. He had neither stock nor money, or property of any kind ; purchased 360 hoggets from Abraham and Williams fo* i'6s ; gave a three-months' bill for the sheep, which debtor sold for cash in Jnne to aMr Standen for L 65 ; banked L4O, and with the balance paid Bramwell Bros. Lls and purchased a cow for L 6, also a horse for L 6 ; could not say what he did with the remainder of the money ; on the 29th of June purchased 150 sheep from Gorton and Son at 10s Id each, on a three-mouths' bill. MrE. Gorton asked debtor several questions in reference to his affairs, which were entered in a pocket-book, and debtor signed his name thereto ; in August gave a wool lien of L 25 on the sheep ; after the execution of the lien, took the sheep to Colyton sale yards and sold them through .the agency of Barraud and Abraham for 12s each ; received LBO for the sheep ; did not tell Barraud and Abraham that debtor was selling sheep over which he had given a wool lien ; with the money paid Abraham and Williams the amount he owed them for the first flock of sheep placed on the farm, and the balance of the money was paid into the Colonial Bank at Palmerston, to be remitted to the Colonial Bank at Feilding ; debtor then went to Abraham and Williams and purchased 26 head of cattle for LlO3 on a three-month's bill to try and make money out of them. Re T. M. Jackson, motion for an order directing F. S. Guy to deliver to the Assignee certain property in the estate. Mr Cooke appeared for the D.O A., and Mr Fitzherbert for Mr Guy. After Mr Cooke had made his opening remarks, His Honor said he was of the opinion that the case should be tried before a jury, and an adjournment to next sitting of the Court was granted for that purpose. Mr Cooke obtained leave to amend his motion. Re Franklin-Browne Bros., application for discharge. Mr Fitzherbert appeared in support of the application. — His Honor adjourned the application until bis decision had been given in reference to the proof of debt lodged by W. Franklin-Browne (senr.). Mr Fitzherbert made an application to have the proof of debt of William Franklin-Browne (senr.), a creditor in the estate of Franklin -Browne Bros., npheld. — The applicant said his chief reason in coming before the Court was to prove that he had not benefitted by his sons' failure, as asserted at the first meeting of creditors. — The application was opposed by the D.O.A. — His Honor intimated that he would adjourn his decision for one week, when it would be forwarded in writing to the Clerk of the Court. j The Court then adjourned until 10 o'clock this morning.— Standard.
