In Bankruptcy.

A meeting of creditors in the estate of Peter Rugsted, carter, a bankrupt, was held at the Courthonse yesterday after* noon. Present— The D.O. A. (Mr G.J. Scott), and Messrs Prior (representing the debtor on behalf of Mr Gay, vrho. was unable to attend), L.E. Beade (representing B. Sheehy), A. Richmond (representing W. F. Elkington), W. A. Sandilands (representing R. R. Collins), W.G. Haybittle, O. Cooper (representing Barraud and Abraham), R. B. Collins, G. Wheeler, A. Eade, G. H. Saywell, J. Gould, and T. B. Chamberlain. *^ho sworn statement of assets and liabilities was as follows : — Liabilities.— Secured: B. B. Colhns, Feilding, £27, estimated value of security, £145; unsecured: W. F. Elkington, Makino, £7 7s 2d; B. Sheehy, £91s6d; A. Eade, £5 10s ; J. Gould, £4 8s 3d ; Barraud A Abraham, £16; W. G. Haybitte, £15 9s ; Saywell Bros., £23; Trevena, Feilding, £14; Smith, Colyton, £12; Ellis Bros, and Valder, Moawhanga, £2 7s ; Cham- ■: berlaiu Bros., Feilding, £80; G.Wheeler, Awahuri, £14 ; Meehan, Ohingaiti, £1 10s ; George Davis, Taonui, £26 (wages); total, £230 12s lld. Assets, estimated at £116. The proved claims up to the time of meeting were — W. G. Haybittle, £18 lis; R. Sheehey, £10 2s ; T. R. Chamber, lain, £80 4s 7d ; Barraud and Abraham, £22 ss; and R. B. Collins. During tho examination of the debtor, Mr Sandilands said there would be, in addition to the above, a claim of £7 by B. Hammond, and also a claim by Frank Spencer. Debtor said the latter claim would be about £3. In consequence of these additions the liabilities amount to about £251 ss. The debtor being sworn said: Had not kept any cash-book, or any other books, except the bank-book ; G. Davis started to work for debtor last July twelve months (1892) ; Davis was getting 25s a week till March, 1893, and it was then raised to 30s ; paid all moneys to Davis by cheque ; in Jannary, 1892, had eight horses, a waggon, a dray, harness, a hack mare, and a foal ; had now five draught horses, a hack mare, two foals, the waggon, dray, and harness ; values two horses at £25 each and three at £15,' the hack at £3, the "foals £3, the waggon about £30, dray about £10, harness about £10 ; had no book at all, and made up the statement from memory. In reply to Mr Haybittle, debtor said : Tho last amount paid into the bank was in June last year; worked for three months from Feb. to last of May for the Survey Department; proceeds were all paid away to men who were working for him ; the cheques for the metalling waft paid into Mr Creech's account ; there were three in the job ; the job was not finished on account of the wet weather ; his part* ners, Wren and Creech, would complete the work ; was a partner in the firm yet ; had no idea what his share wonld come to; the contract was for metalling 68 chains for wbich they were to get £581 ls 4d ; £300 had already been received by the party ; there was still £200 to come and it wonld cost about £60 to complete the job, could not say what his snare would be ; knew the horses were mort* gaged when he sold two of them ; the work was right enough but the weather was so bad that he could not make anything out oi it and tbey only paid the men's wages, there was a deposit of £20 on the contract ; ont of the £300 coming to the partnership £100 was owing Ry Mr Prior : Had been paying off the £100 mortgage and tbere was only £30 owing on the horses. In reply to Mr Cooper : Had furniture to the value of about £30 ; had a wife and two children. Proposed by Mr Haybittle, seconded by Mr Cooper, That the Deputy Official Assignee realise the assets, as quickly as possible. — Carried. Proposed by Mr Haybittle, seconded by Mr Chamberlain, That- tbe Deputy Official Assignee, through Mr Sandilands, be re* quested to recover two horses or their value, from Mr Robinson and Messrs Ellis Bros, and Valder.— Carried. Mr Haybittle did not think there was any fraud intended by debtor although things had been greatly muddled. Proposed by Mr Haybittle, seconded by Mr Cooper, That the debtor be allowed to retain what household furniture he has.— Carried I The meeting then adjourned.
