» This Dav. (Before Messrs Monckton and Mackay, JP.SI John Nichols charged Mahira Raharuhi with a common assault od the 2lst ult., at Awahuri. Mr Sandilands for plaintiff, and Mr Prior for the defendant. John Nichols (the plaintiff) deposed that the affair took piice on the date named in the Awahuri store, whilst he was cutting up some tobacco ; the de« fendant asked him for a fill, aad on his refusing to give him one a slight scuflie ensued, and the defendant struck plaintiff a somewhat severe blow on the head ; ultimately two or three people came oyer from the hote! and took the defendant away ; the latter was in drink at the time Mrs Nicholson and Frederick Mann, who were present in the store at the time, gave evidence which corroborated the plaintiffs version as to what happened. Dr Sorley deposed, that some months ago, he and Dr Johnston issued a certificate as to Nichol's temporary derangement of the mind, and the latter went to the Wellington Asylum for treatment. The effect of a blow on the head might hare a tendency to bring on his insauitjagain. The defendant gave his version of the affair, and said he did not remember striking the plaintiff' on the head. The Bench m delivering judgement, stated that they considered the affair a very trivial one, and fined the defendant ss, each party to pay their own costs. This concluded tho business.
