« (Before Major Tuke, 8.M.) j The following cases were heard afterwe went to press on Thursday last :— la the case of Oliver versus Stewart, judgment was for the amount claimed, £29 19s 2d, not £5 19s 2d as appeared in our report. George Boness v. Richard Bobinson ; . claim £7 4? 8d for thrashing gram. Mr Prior appeared for the plaintiff, and Mr Saudilands for the defendant. There was considerable evidence given in this case, which was simply a question of accounts between the two parties. The defendant claimed a set off of £9 17s 6d, of which amount the plaintiff admitted £6 os to be correct. A number of witness were examined both for the plaintiff and defend--1 ant. Counsel haying addressed the Court, the Bench gave judgment for the plaintiff for the sum of £1 Ids, each party to pay his own costs. G. Mcßride y. F. Wellsman ; claim £9. Mr Prior appeared for the plaintiff, and Mr Sandilands for the defendant. Plaintiff's counsel stated that £4 10s has been paid into Court by the defendant, and plaintiff now sues for the balance of £4 10s with costs. Mr Sandilands said, the defendant gave an order on Somerville and Co. for this amount, and when that firm went into liquidation, the plaintiff turned round and sought to recoyer from Wellsman. Counsel quoted cases from the N.Z. Law reports, and Chitty on Contracts, to prove his contention that the plaintiff must be nonsuited. His Honor nonsuited the plaintiff, and stated that the wrong party had been sued, and allowed 10s expenses of one witness called for the defence, with costs of court 31s against the plaintiff. Jatnes Huddleston v. F. J. Chell; claim £10 4s fj.s.) Mr Richmond appeased for the piaintiff. Plaintiff gave evidence showing that the defendant was earning good money and had had several jobs since the order was made in May last. J His Worship issued an arder for defend, ant to pay 30s per month, the first instalment to fall due on the 3rd of December. The Court then adiourned.
