« Wednesday, July 14. (Before Dr Monckton and Messrs H. L. Sherwill and G. Kirton, J.tVs Thomas Rosamun was charged by HDuggan with aiding and abetting Robert Parr and William Lowe in the committal of a common assault on the evening of Monday last. Mr Sandilands for plaintiff, and Mr Prior for defendunt. Plaintiff deposed that on Monday evening at 7.15 ho was overtaken by the accused and two others named Parr and Lowe, defendant instigatod tho latter to assault him, was kicked, but could not say that the accused did it. Plaintiff was cross-examined at great length by Mr Prior. Leo Matthews and George Sopp deposed that they had seen Roeaman, Parr, and Lowe together near Leng Kee's shop in Grey street and Matthews gave evidence that he heard one of the three »ay " Here's this bloke in the Chinaman's. A few minutes after Duggan left nud they neard someoue sing out, and on their running to the place found Duggan with his face all over blood. Cross-examined by Mr Prior, but their evidence was not taken. Constable Tuohoy deposed that plaintiff came to his house about 7.30 p.m. on tho night in question in a miserable plight, with his nose and face bleeding and his clothes in a very muddy aud dirty state, and complained that he bad been assaulted by the three defendants. Defendant gave evidence on his own behalf, and in cross-examination admitted that ho was aware Parr and Lowe wont down Grey street for the purpose of assaulting Duggan, and be accompanied them. Defendant was fined 40s and costs, or in default 14 days imprisonment with hard labor ; half of the fine to go to the plaiutiff, and 7s costs. Robert Parr was charged with assaulting Henry Duggan on Monday last by stnkiug him on the head and face aud shoving him into a ditch ; thereby causing him pain and putting him in bodily fear. Mr Sandilands for plaintiff, and Mr Prior for defeudant. Plaintiff's eyidence was the same as in the former case ; he admitted in crossexamination that he struck defendant in Gay's stables a week before, but it was because the latter called his mother foul names. Thomas Rosaman deposed that he was with defendant on the night in question ; whon they overtook Duggan in Grey street Lowe jumped about in front of him to prevent his getting away from Parr ; was sure Duggan hit Parr with his stick. Defendant deposed tho troublo all arose from an altercation which took placo at Gay's stables the previous week, when Duggan and he used abusive language to one another, and that he offered to fight Duggan if he would take off his ring but the Infer declined. Mr Prior addressed tho Bench and urged that it was a fair fight betweeu Duggan aud Parr. He also stated that plaintiff waa not so inoffensive as he wished to make out. The Bench on giving their decision, stated that they were determined to put down larnkinism, and fined defendant £5 or in default two mouths imprisonment with hard labour ; also that he must bo bound over to keep the peace for six mouths, himself in the sum of £10 and oue surety of £10, and costs 7s ; £2 of the fine was to go to Duggan.
