This Day.
(Before Messrs Sherwill and Kirton, J.P.s William Lowe was charged on tho information of Constable Tuohoy that he did unlawfully assault and beat Henry Duggan on the evening of Monday last. Mr Sandilands for plaintiff. Henry Duggan and Rossaman repeated the evidence given in tbe previous cases. Defendant, on beiug sworn, stated that he saw Duggan in tbe Chinaman's shop, and called Parr's attention to him, when Parr said " That's the man I want " ; deuied ever striking Duggan ; waa aware Parr meant to go for Duggan from what j he (defendant) had heard in town ,* ran away towards Manchester street and then turned back opposite the Wesleyan Church, hoping to get away without being recognised. The Bench considered that though Parr was the pnncipal aggressor, defendant's conduct was most cowardly iv getting in Duggan's way and thus preyentiug the latter from escaping their assaults. j The defendant was fined £s—of5 — of which £2 was to go to Duggan— 9s costs, solicitor's fee, 21s ; and to be bound over to keep the peace for 12 months, himself in the sum of £10, and oue surety of £10, | or in default two months' imprisonment I with hard labour. j
