APPEAL COURT’S JUDGMENT [Per United Press Association.] WELLINGTON, March 27. In the appeal case the King versus Power the judgment was that the appeal must be allowed, the court being satisfied that the respondent had no cause of action against the Crown. Costs were allowed on the highest scale. [This was an appeal by the Crown against Michael Power, of Whangarei, agent. The tacts were that Power became a member of the Police Force in August, 1911, and was dismissed on March 28, 1928. In February, 1928, he was charged by the Commissioner of Police with having made improper use of property of the Government contrary to the police regulations. On February 14, 1928, the Inspector of Police at Greymonth held an inquiry into the charge, and Power was found guilty and fined £3, which was deducted from bis wages at the end of the month. On March 19, 1928, being then at Ross, P.ower received a telegram from the inspector at Greymonth informing him that unless he resigned at once he would be dismissed. He did not resign, and was dismissed on March 28 of that year. In a special case brought between the parties in December hist Mr Justice Ostler held that the dismissal was such as to give rise to an action for damages, and that such notice as Power received was not sufficient to terminate his contract of service.]
