Tuesday, October 24. (Before J. Bathgate, Esq,, R.M.) Holt ▼. M‘Landless, Hepburn, and Co.— In this case his Worship gave his decision on the nonsuit point raised at the previous hearing. Plaintiff was nonsuited. Judgment was given for plaintiffs by de- 1 fault m the following cases Miller v. James King, claim L 3 17s, for rent due and application for an ejectment order; Davidson v. Alexander M'Kinnon, L 4 15s, for clothes supplied (his Worship inquiring what material the clothes were made of, was in- , formed that they were constructed of Vene- j tian blue cloth); Davidson v. Anderson, LG j ss, for clothes supplied; Meenan v. Hugh Lyons, 1 3 14s 6d, for goods supplied; George Eliott v. iEneas Ross M'Leod. L2l, on a dishonored promissory note ; Larking v. Bell, L2O, on an 1.0. U. Harris v. Denchrass —t-'Jaim for boots supplied. Mr Lewis appeared for plaintiff; Mr Finn for defendant. In this adjourned case, the evidence of George Holder, shopman to plaintiff, was taken, proving the delivery of the goods.—The case was then further adjourned to November 13, defendant being now at sea. R. Cowan and Co. v. G. S. Stewart. — Cla : m I-2 16s 4d, balance of account for goods supplied, and L 7 10s for board and lodging for five weeks —Defendant admitted the first item, but said that plaintiffs wife •ivited him to stay in the house with them, hr having been a great friend to them, tarted them in business, and lent them 150 in cash. Witness often proffered payment to them for his board, but they poohpoohed the idea of charging him anything —Plaintiff denied all this and said that defendant invited himself to the house one Saturday night and stopped there five wee : s. —His Worship said 30s a week for board and lodging “ was rather salt,” and. appea' ed to think that good board and lodging can be obtained for 18s a week. He would allow 20s a week, and judgment would be given for L 7 16s 4d with costs.
