RESIDENT MAGISTRATE'S COURT.

Fbhuy, August 11. (Before J. Bathgate, Etq., R.M.) W. H. Calder, of Invercargill, v. Bennett and Dow.—Claim of LIOO for wrongful conversion of certain timber landed on the Rattray street wharf. Mr Holmes appeared for plaintiff; Mr Bathgate for defendant. —Plaintiff's case was that the timber was shipped at Invercargill on November 5 last in the Comerang, and was intended for transmission to Whitelaw and Co. for sile by auction. By some mistake, however, the bill of lading was not en-dor.-ed or delivered, but a specification of the timber was sent to Whitelaw and Co. by Mr Calder. Messrs Whitelaw, on applying for the timber, were informed that it was booked in the manifest to the present defendants.—Mr Bathgate, for defendant, asked for a nonsuit on the .ground that there was no evidence of demandor refusal.—His Worship reserved the pcint, and evidence was taken for the defence.—Judgment was reserved.
