RESIDENT MAGISTRATE'S COURT, PORT CHALMERS.

Tuesday, Maech 30, (Before T. A. Mamford, Esq., R.M.) Assault. —James Martin, steward of the ship City of Dunedin, charged Captain Ross with assaulting him on the 21st inst. From the evidence adduced it appeared the captain was entertaining some friends at dinner, and nad occasion to complain of the manner in winch one of the joints was served up, and on complainant replying the captain took him by the coat and struck him.—For the defence it was stated that the steward had caused the captain considerable annoyance during the passage aut, and had threatened to leave the ship.

On the occasion in question he had been most rude and insolent in his behaviour, and Cantain Ross put him out of the cabin.—ln giving judgment, the Bench said it was evident from the manner in which the complainant had given evidence that his conduct during the voyage had not been what it should have been but the course the captain should have adopted was to have had plaintiff examined by a medical man and if he was able to work to have brought him before the Court. An assault had been committed and defendant would be fined 20s and costs; for a similar assault on the 25th inst.. Captain Ross was fined 40s and costs. Mward C#illigan, for assaulting Ah Poy, was find Is and costs.
