This Day. (Before A. C. Strode, Esq., R.M.) Civil Cases. Wilson and Maddox v. Iveson. —L 5 10s, for goods supplied. Judgment by default for the plaintiff for the amount claimed, with costs. Scanlan Brothers v. Pratt.—L3 ss, for materials supplied. Judgment by default for the plaintiffs for the amount, with costa. Conway v, M ‘Leod. —LI 13s, for work
and labor done. Mr Haggitt for the plaintiff ;Mr Stout for the defendant. For; the defence, it was contended that the plaintiff was a partner with the defendant, and that the work claimed for was included iirthe contract taken. The evidence of the defendant, however, went to show that plaintiff was not employed by him, but by some sub contractors, Mr Haggitt accepted a nonsuit. Edwards and another v. M'Leod.— L 24 10s, for work done in pile-driving, and loss of time through the act of the defendant. Mr Haggitt for the plaintiff- ; Mr Stout for the defendant. From the evidence of the plaintiff Edwards, it appeared that he entered into a contract to drive a number of piles in connection with the Port Chalmers Railway; that great delay took place in consequence of the defendant not providing material for carrying out the work, and that he promised plaintiffs should be compensated for the delay. The whole of the work from 1 the 15th March to the 26th April might have been done in six days. [Left sitting.]
