RESIDENT MAGISTRATE’S COURT.
This Day. (Before A. C. Strode, Esq., R.M.) APPLICATION FOR POSTPONEMENT. Mr Ward, on behalf of the defendant, Macklin, applied for an adjournment of the case of 0. Young v. Macklin, on the ground that the evidence of the plaintiff was necessary to the defence and that he was in gaol. Mr Catamore objected on the ground that application for his appearance might have been made to the Supreme Court under the provisions of the Habeas Corpus Act. His Worship decided to postpone the case on condition that proper steps be taken to secure the attendance of the plaintiff. Civil Cases. Watson and Gow v. Gillespie—Lß l l s 6d, for balance of account for work done. Juclgment by default for the plaintiff’s for the amount. Wright, Stephenson, and Co. v. Hugh Falconer. Mr Haggitt for the plaintiff. This was a claim for L 29 7s lid, the amount of a dishonored acceptance, with interest. Judgment by default for the amount, with costs. M‘Callum, Neill, and Co. v. W. Allen— L 55. Mr Turton for the plaintiffs. From the evidence it appeared that the defendant was sub-tenant under the plaintiffs of a piece of ground at Anderson’s Bay, and the action was brought to recover the last portion of the rent due, at L6O per annum, and the value of a building erected on it, value L2O, which the defendant had removed from the ground. Mr Turton put the defendant I into tlx; y/itness box ; but he would not give information as to tb f c removal of the building ; from the ground. Mr Tiptop applied for a non-spit, which was'^Vmitied ‘‘ Pritchard v. ‘Barry—Clalni fog L 25 for a new cart, Judgment by default for the plaintiff. One case was dismissed for non-appearance and eight withdrawn.
