This Day. (Before A. C. Strode, Esq., R.M.) APPLICATION FOR POSTPONEMENT. Mr Ward, on behalf of the defendant, Macklin, applied for an adjournment of the case of 0. Young v. Macklin, on the ground that the evidence of the plaintiff was necessary to the defence and that he was in gaol. Mr Turton for the plaintiffs. From the evidence it appeared that the defendant was sub-tenant under the plaintiffs of a piece of ground at Anderson’s Bay, and the action was brought to recover the last portion of the rent due, at L6O per annum, and the value of a building erected on it, value L2O, which the defendant had removed from the ground.
