SEQUEL TO ACCIDENT

A garage attendant, Patrick Smith, was the plaintiff in an action for damages brought against William: Keith Wickens, motor mechanic, of' Wellington, in the Supreme, Court yesterday,'before His Honour; Mr. Justice Blair.. • Mr. V. W.: Ongley, -with' him Mr.\o. H. Arndt, appeared for the plaintiff, and Mr. P. 8., Cooke, -frith him Mr.' &. Christie; for the defendant. - ■The plaintiff claimed that-.while;;he was kneeling down examining a. motorcycle in Wakefield street on 13th:,,i?.ecember last, he was .struck by^another motor-cycle ridden by .the defendant, and was severely injured. It .wak;alleged that the accident was due to the defendant's, negligent and^ unskilful riding. \ A claim was ''made .for.v£s'J.3 special damages and £ 1500 general damages. ' .' ■ The defendant denied that he!.had been negligent or unskilful' in his.handling of .the'motor-cycle.';.-He contended that the accident was due to negligJenc© onthe part of the plaintiff. •'•. :'■■ , At the outset Mr. Ongley- said 'that it was thought at first' that-the^: plaintiff's neck had been- fractured, and i;he claim for ffi 1500 general damages was based on that assumption.'
