' The Appeal Court upheld Messrs •try s appeal from the judgment awardl nf, Cyril Tolley £100°- The C^rfc held that though Fry's action in 'not; obtaining Tolley 5s consent to the advertisement was inconsistent with the decency of life, it was not defamatory.
Cyril Tolley, the amateur golf champion, was represented in an advertisement with a cake of chocolate sticking out of his pocket. He took action; against the makers and was awarded damages.
