Thursday, February 14th, 1878, • • Police v. John Fitzgerald.—Cruelty to a horse by working it with sore shoulders. The evidence was very contradictory, and His Worship in giving judgment said he would not say that accused had committed perjury, as it required two positive and distinct witnesses to prove. However, be could not but say that accused had prevaricated. He would not impose a heavy penalty, but such an one as would prevent a recurrence of the offence.—Fined 10s, and costs, 6s 6d. C. T. Marie v. Richard Holden.—Claim, L2, for damages to growing crops by four head of cattle.—Mr F. J. Wilson, for plaintiff'. .Evidence of plaintiff being taken as to damage and proving ownership of cattle, and that of one witness (T. H. Dunn)’m proof of damage and height of fence, the which he stated averaged 4ft. Gin. from tho gutter to the top of the fence, and defendant failing-either by himself or witness-in upsetting plaintiff’s evidence, though they expressed their opinion that none of defendant's cattle were in the paddock.—Judgment was given for tho amount claimed, and costs, 16s. Swan v. Crummy. Mr Wilson for defendant. Disputed account for carriage of timber from Tapanui to Cromwell, on which half-inch measurement Was charged as full inch.
