COST OF RECOUNT
Defeated Candidate To Pay £199/16/MAGISTRATE’S ORDER (By Telegraph.—Press Association.) DUNEDIN, June 26. In a reserved decision delivered today Mr. H. W. Bundle, S.M., ordered Mark Woolf Silverstone to pay the costs of the magisterial recount of the voting in the recent city council election amounting to £199/16/-. The magistrate held that Silverstone had no reasonable grounds for believing that lie would be found to be elected on the recount, and he said he considered it wrong that a. defeated can’didate should be allowed lightly to cat! for a recount. He accordingly ordered that Silverstone’s deposit of £lO be applied toward the costs and that the balance of £lB9/16/- be paid by him Details of the cost were as follows:— Stationery, £6/15/-; preliminary preparations and organization for the recount, £lO/10/-; taxi fares, cartage, etc., for transporting election material from the Magistrates’ Court and return, £1 2/-; hire of the Town Hall for two ni**hts £l6: wages of noil clerks engaged on the recount, £164/7/6; costs of advertisement of a notice of recount, £1 1// “l' do not think that the costs mentioned in the magistrates’ judgment are a iust estimate in accordance with the Act" said Mr. Silverstone today. ‘They appear to be rather a penalty for a sen--0118 breach of the law, and I am taking steps to have the whole question of costs reviewed.”
