CHARGE OF ASSAULT
DAMAGES AWARDED PLAINTIFF,
At the Lowor Eutt Magistrate's Court on Wednesday, M. W. Welch claimed £2$ from >C. W. Howard, as damages for an assault, whioh was alleged to have been committed on the evening of Decern, ber 13, 1919, in th© vicinity of the Lower Hutt Town Hall. Mi 1 . E. P. Bunny appeared for the plaintiff and Mr. P. W. Jackson for defendant. ' ;"
It was stated that at the time plaintiff was suffering from a poisoned finger, and hud his arm in a sling, and that defendant had called him "a dirty tkunk," and had pushed him off the footpath. His Worship, Mr. W. G. Itiddell, S.M.. eaid that the offensive words used would f) to show the condition of the defendant's frame, of mind at the time. The Court was unable to see why Howard had interfered with the plaintiff. The damages claimed were rather'on the.ex* cessive side,: but judgment would be for plaintiff for J2lO and costs £5 lis.
