RESERVED JUDGMENT. Mr. F. V. Frazer, S.M., delivered reserved judgment in the case G. H. Hunt v, L. Morrison, a claim for for loss of a portion of a crop of ' tomatoes through alleged negligence on the part of the defendant. It was alleged that a number of the defendant's cattle destroyed the gate and fencing of plaintiffs property, and a portion of his crop of tomatoes was thereby destroyed. The claim was based alternatively on trespass and negligence. There was a conflict of evidence as to whether the gate opening on to the. road along which the bullocks were being driven was <pen or closed, plaintiff stating that it was closed and fastened, and the drovers holding the opposite opinion. The real diiestion, said His Worship, was as -lo whether the drovers w;re negligent, and lie held that there was no definite evidence of Mich negligence, and, further, the contention that plcnliff should recover on account of-trcspass was not sound. Plaintill' would be non-suited, and costs would be allowed the defendant. Security for appeal was fixed at .£lO lfls. At the hearing Mr. P. W. Jackson appeared for the plaintiff, and Mr. 0. Beore for, the defendant. JUVENILE COURT. At a sitting of the Juvenile Court, Mr. T. V. Ficger, S.M., admonished and discharged two small boys, who were charged, with"having broken into a stable at Island Bay* on Juno U and stolon a •three-feet rule and n packet of rivets. Tiie, boys, binding the stable deserted, made investigations, and ■ then entered the building. The father of one rf tho boys,-undertook to see that tho stolen property was returned.
