A WIDOW'S MAINTENANCE

His Honour Mr. Justice Chapman delivered judgment on Saturday morning in respect.to an application for increased maintenance under the Family Protection Act, 1908, made by Marianne Redwood. 'His Honour came to the conclusion that the will of the testator did not provide adequately for his widow, the plaintiff. Thp estate in the hande of the defendant (Hamilton Joseph Redwood) was worth £30,000, with an ,e:irning power commensurate with the. value, and, by the will became the prnp.ir;v of the defendant, the testator's srm 'mid only child. Plaintiff, who was the testator's second wife, now bad about ,£SOO of her own,-which she had lent to the testator, and the latter, by his will, made on the day'of-the marriage, ■ left her .£250 a year to bo reduced to .£lOl in the event of her marrying again. This His Honour increased to .£450. The condition is not to apply to the increase, bill; the allowance might be increased' or diminished by the Court if the circumstances altered. A casli payment of •£'lso whs also allowed the plaintiff, to enable- her to furnish a house -if aim thought fit so to use it. At the hearing Mr. C. P. Skerrott, 8.C., with him Mr. Crombie, appeared for the plaintiff, onil Sit John Jindlay, K.C.", with him Mr. T. F. Relling, of Blenheim, for defendant. 4
