ENEMY ALIEN LANDHOLDER
FORFEITURE OF PROPERTY. Before His Honour the Chief Justice (Sir Robert Stout) yesterday the Solici-tor-General (Sir John Salmond, K.C.) applied, on behalf of the Attorney-General, for an order of forfeiture of a. piece of land containing forty-three acres, owned bv an alien enemy named Carl Voltz. 'The application was made under sections 3 and 7 of the War Legislation Act 1917. .Carl Voltz was an unnaturalised alien, and came'to New Zealand in 1010 In 1016 ho purchased a piece of land (forty-three acres) at Wainu, and was at present the registeied owner of the same. His interest was subject to two mortgages, both held by one person, ii. woman. The order asked for was for the forfeiture of the fee simple subject to the morteage. Sir John Salmond, K.C., explained that the AHornr.y-Geii. eral had assumed that the mortgagee did ■'not know she-was dealing with an enemy alien- but for that charitable assumptinn the Attorn»>y-Gcn«ral could have claimed tho absolute forfeiture of the land. Voltz was a German, and was represented. His Honour granted the order, remarki"" t.hnt it ouMit to be generally known by this time that no enemy alien could hold land in New Zealand.
