MAGISTRATE'S COURT
INDICTABLE OASES. Mr. h. G. lleid, S.lf.. presided at llio Magistrate's Court yesterday. Chief Detective Boddam applied for a remand in the' ca«e of David Hodges, charged with attempting to obtain from Henry JTartindalo and others the sum of £975 by false pretences, also with respect to John Edward Fhzgerald and John M'TVilliams, who appeared on summons in connection with the case. Mr. G. G. G. Watson, on behalf of Fitzgerald, objeotod Btrbngly to the adjournment, end maintained that tho police had had sufficient timo to prepare their case : It was very unfair to Mr. Fitzgerald that thero should bo any delay, for it injured his reputation and prevented him from offering any refutation of the allegations made asainst him. Ghief-Detootrre Boddam, in reply, stated that under, ordinary circumstances he would have been prepared to go on, but William Campbell Fraser, who was jointly ohargod with Hodges, was under criminal subpoena to appear at Wanganni, where he vms at present. It would be unreason-α-bio of the police to bring witnesses from all over the Dominion, which would have been neces3ary, on the chance that Fraser would bo present. Fra-ser's case had been adjourned to Friday, and a further remand would be asked for so that all the cases might be taken on Wednesday, September 5. A remand xs requested was granted. A. H. jrGarty was remanded for a. week for intertills an advertisement in a. newspaper in res-nect to the kinemntngravli picture "Intolerance," whereby the said newspaper became im indecent document under the Indecent I'ubTications Act. . ALLEGE© THEFT. James O'OonneJt was charged that on August 22 ho did steal from tho person of- William Senior the sum; of £4 in money. Mr. P. W. Jackson appeared for accused. , ■ ■ According to the evidence, Senior, who is a boilermalier, and the accused worked together at the Patent Blip, and finished work there on August 17. On. tho date of the alleged theft the complainant, met the accused in tho Ifew Zealander Hotel, and in tho course of conversation accused admitted that he had spent all- his money tho previous day. Senior stated that lie had ¥omo money to draw from tho Union Oompany, and requested the accused to show him tho way to tho office. They went to the office together, where Senior drew £7 195., 6d., in soven .61 notes, one 10s. ■note, and the balance in silver and copper. He gave tho accused tho 10a. note to go on with, arid placed the notes rolled up in tho socle on his left lo?. Tho two then started drinking heavily, Senior becoming quite incanablo. When in Adclnide Eoad a. coal merchant sitting in .his iifllne saw Senior propped up against a billboard, and the- accused Gcarching him. Ho fnlt the Dockets and worked down to tlio portable bank in the sock, from which ha wa-s seen to take what appeared to be notes The' matter -was moptßcl */> t"ie pelice. and Senior was arrested for drunkenness, and lodged in a cell. Samuel Heyworth, for whom Mr. V. W. Jackacu appeared, ; proceeded against Predoiick Williams lor assault. According to the evidence, complainant, and . tho accused were, cavliiis coal from Uie wharf to tho State Goal Ilopot on August 20, and Williams ".iuinped" tho turn of tho complainant. When tho men reached the coal depot Hoy worth ronvonstrated with Williams, and cha-rac-terißcd his action as a "dirty trick." Williams then struck Uoyworth a sovoro blow on the cyo and knocked him down, and on the latter gelling away followed him up and Klrniik him two moro blows. The. complainant, who is an elderly man. tried to got out of tho way. Williams v> as convicted and fined 40s. and costs, iu default 14 days' imprisonment. OTHER CAMS. ' Henry SLcvens pleaded guilty to the theft of a pair of shoes valued at 1 14s. id., tho property of B. Hannah and Co.; theft of a 3 umbrella value 7s. 6d.. tlio properly of tho New 'Zealand Oothing Company., and tlicft of two lengths of suiting, value £4. tho property of somo person c-r j.-cr-sons unknown. Ho wa« sentenced to two months' imprisonment on ca-eh chargp, Iho terms to be cumulative, making tlio scfltonco six months.
A plea, of guilty was entered by a young girl charged , with the theft of postal notes. She was fined 40s, and ordered 1o refund the stolen money.
An old man, somewhat deaf, name* James JTKcovpT, was convicted of boins a rogue and vagabond in that he waa found by night on property on tho King's Wharf belonging to tho Harbour Jloard. lie wa«s scutenced to a month's imprisonment;
