CLAIM FOR COMMISSION. In the Supremo Court on Saturday His Honour Mr. Justice Chapmaii delivered judgment in a ca;se on appeal heard on October 18, in which E. B. Hare, land ageni, of Fahiatua,' was tho appellant, and W. Lingard, land agent,. Wellington, tho respondent. The appeal was from a decision of. Mr. D. G. A. Cooper, S.M., who had giveu judgment fortLingard for £25 on a claim for half commission on tho salo of a. property at Pahiatua effected by Hare. The basis of. Lingard's' claim was that he had introduced the purchaser to Hare. Tho ground of appeal was that the Magistrate had wrongly decided tho question of fact, and also, that tho matter had been-'pre-
viously 'determined by arbitration _of the Land Agents' Association at Wellington, who had decided tho matter in favour of Hare. On behalf of tho respondent, it was claimed that the arbitration of Land Agents' Association 1 was indecisive, and that the matter ; was left open for decision by tho Court.
Tho appeal was allowed with £7 7s. 'costs.
At tho hearing Sir. T. Noavo appeared for appellant, and Sir. Douglas Jackson 1 for tho respondent.
